Injured in an Auto Accident: Do I Really Need a Lawyer?

 

According to the Pennsylvania Department of Transportation’s 2006 Pennsylvania Crash Facts and Statistics , over 100,000 people will be injured in auto accidents in Pennsylvania this year.   After experiencing an injury caused by another driver, most people don’t know what to do.   As an experienced automobile accident injury lawyer, my goal is to deliver peace of mind to my clients in what is often a very difficult time in their lives.  

In the past I’ve had injured victims ask me:   “Do I need a lawyer to help me against the other driver’s insurance company?”   My answer in almost all cases is “Yes!!”

When injured in by another driver in an automobile accident, motorcycle crash, or tractor trailer accident, an injured person has many things to worry about.   First, and most importantly, the injured victim needs to worry about getting better.   My grandmother used to say “As long as you have your health, nothing else matters.”   There is great wisdom in this often repeated saying.   Quite frankly, after being involved in some type of motor vehicle accident, you’re primary concern should be your health.   However, as soon as your medical condition is known and stabilized, your other worries can quickly encumber your every thought.   For example, thoughts will fill your head such as, “Who will pay my medical bills?   What if I cannot work for a while?   Who will talk to the insurance companies for me?”   Unfortunately, these are just some of the questions that can creep into your mind and begin to overwhelm you.

As a Pennsylvania auto accident lawyer, I take dozens of new calls each month from people injured by others in motor vehicle accidents in Pennsylvania and other states.   As an experienced personal injury lawyer, I am able to assess the case on the phone and always respond to questions honestly in a free phone consultation.   Unlike at other personal injury firms, you will actually speak directly to a lawyer and if there is even a chance that an injured person will need assistance against the other driver’s insurance company, I will set up another free appointment to personally meet with the prospective client.  

In this first meeting, I believe it’s my duty to honestly evaluate the injured person’s case.   In a typical first meeting, I obtain all relevant information about the injured person, the accident, the other driver, the insurance companies involved, the police and other emergency agencies involved, as well as collecting any information available regarding the medical treatment received to that point in time.    I then try to answer all the questions the injured victim may have by thoroughly explaining the entire process from beginning to end.  

At the end of the free consultation, which usually lasts about an hour, I give the injured victim my assessment of their case—which includes my opinion on their need for a lawyer.  

In some cases, primarily those where the injured party did not need follow-up medical attention after the accident, I tell the injured victim that they can handle their claim alone.   In the majority of cases, however, I advise retaining a lawyer to handle the claim.

Even in minor injury cases, an experienced lawyer can help you get a fair and reasonable recovery.   Automobile personal injury claims are extremely complicated and the law that controls the issues changes all the time.   If you make a mistake early in the claim, it could have huge consequences later in the action.   What if you forget to do something or do something illegal?   Do you really want to add stress at this difficult time in your life?  Remember, if you handle the claim alone, you won’t have anyone there to protect you.   If you make the claim yourself, are you really capable of negotiating against the other driver’s insurance company?   Will the other driver’s insurance company advise you of all your legal options, even if it costs them more money?   Can the other insurance company really treat you fairly?  

I think most people realize that handling a personal injury claim without an experienced personal injury lawyer is rarely a good idea.   Still, every so often, some injured people attempt to take on the Nationwides, State Farms and Allstates of the world.   In almost every case, this is a huge mistake!   Trust me, insurance companies only care about one thing—saving their money.   Don’t believe me?   Search the internet on the topic or get a copy of David Berardinelli’s book about Allstate, From Good Hands to Boxing Gloves, which reveals and details Allstate’s policy of using “hardball” tactics to deny or grossly underpay the legitimate claims of its injured victims.
